Bill Cosby will soon be free and out of prison. The controversial comedy icon is getting out of prison early thanks to a legal technicality. Pennsylvania’s Supreme Court ordered for Cosby to be immediately released from prison.

According to Associated Press, the court overturned Cosby’s sexual assault conviction. The court discovered that a prosecutor made a deal with Cosby that prevented him from being charged for sexual assault in the case.

Before his arrest and criminal trial, Cosby testified in a civil trial on the grounds his testimony couldn’t lead to his arrest. The prosecutor agreed to Cosby’s conditions at the time. But in 2015, Pennyslvania’s prosecution used Cosby’s testimony to arrest and charge him for sexual assault. This happened only days before Cosby’s 12-year statute of limitations on the assault expired.

Now, the Pennsylvania Supreme Court ordered the state to abide by their original agreement. The court agreed that District Attorney Kevin Steele must hold to the arrangement by his colleague. But according to AP News, no physical written agreement between Cosby and the prosecution exists.

Ultimately, Bill Cosby caused a split between the Supreme Court falling in his favor. Justice David Wecht overturned the conviction and prevented future prosecution on the matter. He wrote, ” [It} is the only remedy that comports with society’s reasonable expectations of its elected prosecutors and our criminal justice system.”

Bill Cosby Served Almost Two Years in Prison

Bill Cosby is surely celebrating the news. Currently, he served over two years of a three to 10-year sentence for the crimes. A Pennsylvania court found the comedian guilty on three counts of aggravated indecent assault. Andrea Constand accused Cosby of both drugging her and raping her in his house. Additionally, the state required Cosby to register on the sex offenders list in the state.

The court convicted Cosby back in 2018. For the last two years, Cosby has made the State Correctional Institution at Phoenix his home. Just recently, the prison denied Cosby his sought-after parole. The comedian had refused to compete in state-mandated sex offender programs. At the time, Cosby vowed to serve 10 years in prison than admit to any wrongdoing.

The Pennsylvania Supreme Court found that the testimony damaged Cosby’s criminal case and led to the court finding him guilty in his trial. Cosby was one of the most beloved comedians for generations of people. But more than 60 women have stepped forward accusing the comedian of sexual assault.

In his criminal trial, five women testified against Cosby. But the actor has maintained his innocence, stating he had consensual sex with Constand. He also refused to take the witness stand while at the trial. A separate trial back in 2017 ended in a mistrial for the comedian. Additionally, Costand and Cosby settled out of court in a civil trial.
